At the bottom of this report is the Re-enactment photograph of the crime scene photo. It is a very close setup to the actual “clear” crime scene photo sent to the Honorary Consul by the fisherman when he left Tofo which is explained below. I went to a lot trouble to have the re-enactment of the clear photo produced and it’s very close to the actual photograph of Elly’s body the way it looked when the first person to find Elly’s body a fisherman, had taken the photo at 5am.

To ascertain the sequence of facts we need to first look at the evidence given at the inquest on the 23rd August 2023 by DFAT’s Honorary Consul (H/C) .

The H/C has not told the truth in evidence at the inquest and his motive is that he lives in Mozambique which is explained below.

This then becomes a crucial time at the inquest which turns the inquest for Elly’s family on its head!!!

The Honorary Consul was the first official Australian at the crime scene on the 13th November just 4 days after Elly’s Murder. He speaks with the locals and the tourist Association Manager at the crime scene and they all said it looks like an accident. However the one key piece of critical evidence was never talked about at the crime scene in Tofo that weekend the 13th and 14th of November 2016 the ripped apart top which had been totally destroyed ripped from Elly’s shoulder and all the way down her Right side and this is not spoken about or mentioned in the H/C’s report either as a possible struggle taking place raising the bar that this was No accident four days after Elly’s murder.

The H/C clearly states in evidence he stayed the Saturday night 13th November 2016 and left the next day because he is voluntary and that he needed to get back for work on Monday the 15th. He lived in Vilanculos About a five hour trip north to his home. “But the official AFP letter below states he lives in TOFO”!!.

During the H/C visit to Tofo a fisherman informs him that he had taken a photo of Elly when he found her body. The H/C obtained the photo but it came out blurred at the time because the fisherman had a small phone and could not download from his phone so the H/C took a picture of the fisherman's phone with the picture of Elly on the phone but it came out blurred. However you could not see much with this blurred photo, just the outline of a body on the ground with clothes at her knees. The H/C explains this in his evidence given below. They both exchange phone Numbers as the H/C has the fisherman’s number entered in his report. Note;- sequence of relevant transcript Pages with evidence given at the inquest by the H/C below:- T116,117,122,123,124,

The H/C when in Tofo with the blurred photo sends it to the embassy staff in South Africa before he heads home to Vilanculos five hours away. This is when the Fisherman sends the photo to the H/C and it is now the clear version of the photo he sends to the H/C by phone soon after leaving Tofo as he obviously worked out how to do this. The H/C is then shocked when looking at this clear photo because he can clearly see the top is ripped apart. He becomes very worried at this point in time because this evidence proves something is definitely not right here as he had just come from Tofo and there was no talk of a ripped apart top and that a struggle has taken place. He did not want to know about this cover up by the Mozambique police at all as he has to "Live in Mozambique” so he was very worried indeed at this point in time having now been aware of this new evidence and what it has informed him about.

He travels back to Tofo a five hour trip on or around the 17th/18th of November where he “supposably bumps into” the Australian Federal Police/Senior Liaison Officer (AFP/SLO) in Tofo as the AFP letter below states. What's interesting about this meeting is that the AFP claims in the letter it’s an “Accidental contact” with the relevant page of the letter attached below.

However in evidence given by the H/C he clearly states he had NO further involvement with the case when he left Tofo for work on Sunday the 14th November. This is the first time the H/C did not tell the Truth at the inquest as the AFP letter clearly states that during this so called “Accidental Contact” with the AFP/SLO a photo was passed over to the AFP/SLO by the H/C. The AFP/SLO was only ever in Tofo on the 17/18th of November 2016 and the official letter from the AFP states this Accidental Contact happened in November 2016. Therefore the so-called Accidental contact took place around 3 days after the H/C had left Tofo on the 14th November to go home five hours away for work on Monday 15th November.

Therefore the fact is the H/C has at some point traveled back to Tofo 5 hours from his home in Vilanculos. Because he was Very Very Nervous and Worried about seeing this clear photo and what it exposed with the Mozambique police and he is fully aware what happens to people there when talking about the police the wrong way (THEY GO MISSING)!!! I was there in 2018 and the locals were intimidated by the local police. Some of the local police were carrying Ak- 47 machine guns.

Now The H/C and AFP/SLO when talking about this new evidence the clear photo and ripped apart top at this “Accidental contact” they are both then fully aware that they can’t expose the Mozambique police so they keep it between themselves!! Not telling the DFAT/SLO translator who accompanied the AFP/SLO in Tofo about the exchange of the two versions of the same photo, one being “Clear” because of what the clear photo made them aware of with the cover-up.

What also supports this is on Page 21 The AFP action sheet where I obtained the clear photo in 2018 with 60 Minutes on my first trip to Tofo and the AFP/SLO states it's the same photo the H/C got one week after Elly’s death. It was only the clear photo I obtained from Tofo that the AFP/SLO has analyzed on page 21 of his action sheet. Still no mention to the coroner about the ripped apart top from the very experienced superintendent AFP/SLO after he has examined the clear photo again in 2018. In fact the AFP and Mozambique police have not in any correspondence “ever” mentioned the top as ripped apart to this day!!! Even with the latest official Mozambique police report from SERNIC on the 20th August 2020 there is no mention of a ripped apart top at all!!!! But the photo from the fisherman taken at 5 am proves and tells the truth and that it was ripped apart when he took the photo at 5am. We were very lucky the fisherman took this photo as it now proves the Mozambique police cover up either way you look at it and the H/C, AFP Deception cover up in attempting to keep it quiet.

The coroner in his conclusion does not even mention the ripped apart top. However he states during the inquest in my oral submissions to me. “That the ripped top is not in dispute here”. I think they all cover each other's backs as they were all aware the top being ripped apart in the clear photo proves there is a cover-up by the Mozambique authorities. This is why the clear photo was kept in the dark for two years until my trip to Tofo in October 2018. I bet there were a few worried people when I obtained the clear photo on this trip to Tofo. You see the family was never given the clear version, only the blurred version in 2016/18!!!!!

After the Accidental meeting The H/C has to travel five hours back to his home in Vilanculos he is Still extremely worried about knowing about this new evidence from the clear photo and he may have panicked or felt he needed to report it as he sent this clear version of the photograph to the embassy staff in Pretoria South Africa. The two official letters below both confirm this to be the Solid Facts that the H/C had sent the “clear photo” to the Australian embassy in South Africa!!(See letters below)

However in the H/C’s evidence given the H/C clearly states he had no follow up with the fisherman and that he knew nothing about a clear photo. (T 125,128 below) This is the second time he has not told the truth in court at the inquest. I don’t think he was aware of the two letters stating he did pass the clear photo on to Embassy staff when he gave evidence at the inquest because he was on a zoom meeting from Mozambique and he would not know about the letters living there!!!

The reason for the H/C’s motive for not telling the truth is because the H/C did not want to be put in a position to explain any questions about the clear photo at the inquest because of the ripped apart top exposing the Mozambique police. He did not want any trouble with the Mozambique authorities after the inquest. He would have been extremely worried about this at the time. The only way out for him was to say he knew nothing about the clear photo which he did!!! But he did not know about the two letters below from DFAT and the AFP. This has now exposed the H/C with his false evidence given in at the inquest in 2023 turning the inquest on its head for the family!!!!

The fact is the AFP’s letter confirms that “contact” did happen between the H/C and AFP/SLO “Accidental or not” and it also states that a photo was passed over between the two during this contact. As you are aware in evidence the H/C clearly states upon leaving Tofo he took no further part in the investigation after the 14th November and he has not stated he came back to Tofo a five hour drive and Accidently Bumped into the AFP/SLO on his visit back to Tofo on the 17th/18th November 2016 passing over critical evidence at this time in Tofo to the AFP/SLO of a clear photo of Elly’s body of the crime scene!!!

No mention from the AFP/SLO in his own evidence given at the inquest of this “Accidental contact” even taking place with the exchange of this critical evidence with the H/C handing over a photo when in Tofo however he mentions all the other people he had contact with when in Tofo!!

What is also very interesting is in the AFP Action sheet they have nearly redacted all of page 6 in their action sheet around the 17th and 18th November.

The AFP Action sheet is a chronological order of events and dates which have accrued recorded by the AFP/SLO from the 9th November 2016 until 2019 over a two year period.

On page 6 in the AFP action sheet you can see it is nearly all redacted and around the time of the “Accidental contact” taking place on 17th/18th November one week after Elly’s death. (See page 6 Action sheet below)

In all this time in the AFP action sheet the only page which is nearly all redacted is of and around the time of "Accidental contact” on the 17th/18th November 2016. The Australian solicitors official letter below clearly states the meeting between the H/C and AFP/SLO is captured in the AFP/SLO Detective Superintendents “Action Sheet”. This mainly relates to the handover of an image of Ms Warren from the local fisherman. This letter is giving away the vital clues to why this page is nearly all redacted!!!

This letter also acknowledges H/C’s report in the Coronial brief there is no mention of any ripped apart top from anyone at Tofo when he was talking with people about what happened on the 13th and 14th of November 2016 in his official report to DFAT!!

The AFP/SLO is also very careful when talking about the photo taken by the fisherman as he does not reveal in his official statement to the court if the photo is Blurred or Clear. He is also very careful in his action sheet not to mention the photo as blurred or clear. Therefore the AFP/SLO is very careful with his wording on 8th December and 20th November when passing over the photo to the Mozambique inspector in his action sheet saying each time it's the Fishermen's Photo!!!! This is the same with the revised official Moz Police report in his action sheet he states it’s a ( Mozambique Document) Not that its an official police report from SERNIC and it clearly states homicide in April 2017. The AFP/SLO is very good at camouflaging the evidence to some degree just saying enough without saying too much, raising suspicions that a “Crime” has taken place.

However I was to find out later from the coroner's assistant that the clear photo was never entered into evidence by the AFP/SLO, as they did not know either it ever existed two years on.!!! Only the Blurred photo was entered in the AFP/SLO statement into evidence in the brief in 2017. The clear photo was only entered into the brief of evidence later when I obtained it from my first trip to Tofo in October 2018 by the coroner's assistant who said they had not seen the clear version until I gave it to the coroner’s court in October 2018!!!!

The AFP/SLO never mentioned in his statement he got the clear photo given to him. “Because he Can’t reveal the ripped apart top which exposes the Mozambique cover up”. However in the First letter below (Page 2 Photo and other items) form the Assistant Secretary of the Department of Foreign Affairs and Trade (DFAT) Claire McComish dated the 22nd March 2019 it clearly states that the AFP/SLO passed the unblurred version to the Mozambique police on the 8th December 2016. It is also in his action sheet that he handed the photo over again to the Mozambique inspector on 8th December 2016. Once he got this clear photo he had no option to hand it over to the investigating authorities because he got it from DFAT. But he took 14 days to think about it, having No option now to tell his superiors in London as the other letter from the Australia solicitor states the AFP were provided the “clear photo” from DFAT on the 25th November 2016. ( This is because the H/C sent the clear photo to DFAT earlier) However the AFP/SLO had already seen and was given the clear photo One week after Elly’s death with the accidental “contact” with the H/C making them both aware of the Mozambique cover up at this point in time only 7 days after our daughter’s death!!

The reason why the H/C false evidence has turned the Inquest on its head is it breaks the chain of evidence timeline of how the Clear photo was passed on to DFAT, My Barrister and Lawyer were caught by “total surprised” at the time because all the factual evidence pointed to the H/C passing the clear photo over to DFAT. I did not realise how important this was as during the adjournment that day at the inquest they informed me that it is possible now for the coroner to take the clear photo from evidence.

We were to Cross examine the AFP/SLO the next day. This meant that because the timeline was broken with evidence given by the H/C of the clear photo, we could not mention the clear photo and the ripped apart top when cross examining the AFP/SLO. I was not very happy about this situation at all because I had plenty of questions for the AFP/SLO to answer with the Clear photo and ripped apart top. My Barrister was afraid the AFP lawyer would question the chain of evidence timeline with the clear photo if we were to raise any questions about the Clear photo and ripped apart top to the AFP/SLO.

Therefore I needed to clarify the clear photo and ripped apart top at my oral submissions to the coroner. There were other important issues but this was very important and the fact Elly's body was moved as stated by the Mozambique inspector in 2018 because the sand in Elly’s mouth was beach sand not the dirty sand from the toilet block where her body was found.

It was not a foregone conclusion that the coroner was going to grant me my oral submissions. He asked me for a complete rundown of what I was going to say first before he would grant me permission. However, my lawyer sent the basic points and he accepted my oral submissions. My lawyer advised me not to expose the H/C as this will go against me at my oral submissions, possibly closing off my submissions. However I knew if I was to mention the clear photo and the ripped apart top this may prompt the AFP lawyer to question the clear photos chain of evidence and timeline to the coroner which the AFP Lawyer did. (T Page 287 below) However I was surprised after the AFP lawyer questioned the timeline of the chain of events with the clear photo that the coroner said “He thinks there is already information about the sequence of those various steps”. This then stopped me from exposing the H/C at this point in time during my oral submissions because the coroner accepted the timeline with the clear photo. But we did not get to question the AFP/SLO about the Clear photo and ripped apart top or the H/C at the inquest because he states he never got the clear photo from the fisherman and that he had passed it on to DFAT!!!

Conclusion

The facts prove the Australian Honorary Consul and AFP/SLO were both made aware of the Mozambique cover-up one week after our daughters death because the H/C was also given the clear photo from the fisherman revealing the ripped apart top which really worried the H/C to no end!! This prompted the H/C to make contact with the AFP/SLO “Accidently” to discuss the critical circumstances which the clear photo had revealed. Proving without doubt that the murder of our daughter had in fact been covered up by the Mozambique police at the crime scene. Prompting the AFP to redact most of page 6 in the action sheet about the “Accidental contact” between the H/C and the AFP/SLO.
